1. DEFINITIONS

In these general conditions it is understood under 'Flame's Mystery': the venture which under the trading name 'Flame's Mystery' is run and has been registered in the trade register of the chamber of commerce in The Hague with number 32113461. ' Flame's Mystery' (like in www.flames mystery.nl and www.flames mystery.com) is a trading name of Flame's Mystery.
With 'Customer' it is understood: Everyone who by means of the internet sites of Flame's Mystery engages an agreement with Flame's Mystery (see chapter 3.2).
Under 'Order confirmation' it is understood: the order affirmative as defined in Article 3.2 of these conditions.
Under 'Article' it is understood: Article or articles which by closing an agreement between Flame's Mystery and the customer by means of www.flames mystery.nl, www.flames mystery.com or another internet site of Flame's Mystery must be delivered within an agreed period and for which a certain price must be paid.
Under 'conditions' it is understood: these general conditions.

2. RELEVANCE


2.1 On all offers, orders and agreements which are closed by means of the Internet sites of Flame's Mystery and where Flame's Mystery is part of, apply these conditions, with exclusion of some other general conditions. By the becoming of an agreement between the customer and Flame's Mystery, by means of the procedure such as stated in Article 3 of these conditions, the customer accepts these conditions as they are defined on this page.

2.2 Of in these conditions stipulated can be deviated only after written approval by Flame's Mystery, which case the remaining provisions of these conditions onverkort effective to remain.

2.3 All rights and revendications, as in these conditions, and in possible closer agreements for Flame's Mystery are stipulated, are likewise stipulated for Flame's Mystery integrated commission agents and other third parties.

2.4 Flame's Mystery has the right to these conditions and modify the contents of its Internet site and these conditions at any given time without prior notice.


3. OFFERS/agreements

3.1 All offers done on the Internet site of Flame's Mystery be without engagement, until an order affirmative has been received. If Flame's Mystery must raise the price of articles in pursuance of a legal regulation or in strength of pronouncement of the judge, the customer will be informed of this immediately written (by means of letter or e-mail). 3.2 The agreement between Flame's Mystery and the customer comes about at the moment after this last:
. (a) has clicked on the confirm order button one of the Internet sites of Flame's Mystery;
. (b) has placed an order on of the Internet sites of Flame's Mystery by means of completing and correctly filled in of the establishment forms on the Internet site;
. (c) on this has recieved of Flame's Mystery, on his or her e mailadres, an affirmative that the order was received by Flame's Mystery (the 'order affirmative').
If of Flame's Mystery in reasonability cannot be demanded that the agreement is complied with, the order affirmative will not be sent. In this case the agreement does not come about therefore.

3.3 The order affirmative mentions in any case the next information:
. (a) a description of the article(s) which is/are bought by the customer and the number(s) of those bought article(s);
. (b) the price(s) of the article(s); . (c) the name; the address where the article(s) is/are sent to (no PO Box), and the invoice address (also no PO box)(if differently than place of residence and/or deliveryadress);
. (d) the e mailadres and phone number of Flame's Mystery where the customer with questions concerning its if its order is possible rightly.

3.4 The administration of Flame's Mystery applies, subject to counter-evidence, payments done as proof by the customer to the toFlame's Mystery given orders of by Flame's Mystery performed deliveries. Flame's Mystery recognises that electronic communication can serve as proof. By accepting the conditions the customer also recognises this.


4. PAYMENTS

4.1 Orders can be paid according to by Flame's Mystery methods offered. Flame's Mystery does not preserve themselves modify the right for these methods in the middle of in a supply procedure.

4.2 If it is chosen for payment by means of transfer by bank, Flame's Mystery preserve the right for the order unilaterally cancel itself if the payment has not been received after seven working days. Ordered Article or ordered Article are made available then by means of the site (s).

5. TRANSPORT AND TRANSPORT CHARGES

6. DELIVERY PERIODS

6.1 The delivery period of the article(s) is a maximum of 30 working days after reception of the payment, or so much shorter as it has been stipulated in the agreement between the customer and Flame's Mystery. The by Flame's Mystery delivery periods given cannot be considered as a fatal period, unless explicitly differently corresponded.

6.2 When the agreed dellivery periods, for any reason whatsoever, are exceeded by Flame's Mystery, Flame's Mystery will inform the customer in writing of this (by means of letter or e-mail). In that case the customer has to the option to cancel the agreement, by communicating this written (by means of letter or e-mail) to Flame's Mystery.

6.3 Payments which the customer has done within the framework of the implementation of the agreement which is then annulled in pursuance of Article 5.2 of these conditions by the customer, will be payed back Flame's Mystery within 10 working days after she has received the declaration said in Article 5.2, to the customer.

7. Cooling PERIODS

7.1 After the customer has received the by him or her ordered article, he or she has the option of returning the article within 7 working days after the reception of this article, and cancelling the agreement with Flame's Mystery. He or she is not obligated to give a reason.

7.2 If the customer wishes, in accordance with Article 6.1 of these conditions, to cancel the agreement, he or she must communicate this in written form (by means of e-mail or letter) to Flame's Mystery. He or she must return the product then immediate to Flame's Mystery after recieving confirmation the article can be sent back. The customer bears himself the costs of and the risk for the return. When the customer sends the article back in a manner which does not correspond with by Flame's Mystery procedure indicated, he or she loses all rights to repayment when the article does not return or is damaged.

7.3 Payments which the customer has performed the moment he or she revokes the agreement with Flame's Mystery in pursuance of Article 6.1 and 6.2 of these conditions, Flame's Mystery will pay back within 14 days after Flame's Mystery has received the article(s) returned by the customer.

7.4 Flame's Mystery preserves the right to refuse returned articles when damaged or to only credit one part of the already payed amount when the suspicion exists that the article has already been opened, used or damaged by debt of the customer (differently than those of Flame's Mystery or the supplier of the product).

7.5 If the article is returned which is to the judgement of Flame's Mystery damaged which due to an operation failure, negliance of the customer or otherwise is for the customers risk Flame's Mystery will in writing inform the customer of this (by means of letter or e-mail). Flame's Mystery withholds the right to pay back the depreciation of the article as a result of this damage of to the customer amount to contents.


8. NOT WELL, MONEY BACK

8.1 If within 30 days after the customer has received the article, the article appears show a lack, the customer two has possibilities:
(a) he or they is possible in writing ask Flame's Mystery (by means of letter or e-mail) for convalescence, replacement or supply of the missing or poor part of the article:
(b) he or she can cancel the agreement with Flame's Mystery, by communicating this in writing (by means of letter or e-mail).

8.2 If the customer asks Flame's Mystery for convalescence, replacement or supply of the missing or poor part of the article, he or she must return the article to Flame's Mystery. Flame's Mystery will assess within 5 days after the reception if the article is to repair, and to the customer communicates this in writing. If this is the case then Flame's Mystery, within 20 working days after reception, will repair or replace and the return the article to the customer. The costs of reshipping it and/or repair of the article comes at the expense of Flame's Mystery, unless it is plausible that there is a lacking in care of (or a part of the article), by the customer then the costs are at his or hers expense and risk. In that case Flame's Mystery is not obliged to repair the article or replace the missing part of the article. Flame's Mystery will send back the article then in the same situation as those in which she has received the product of the customer. If the article is not reparable, and in the reason of this the customer is in absolutely no manner blamable, then it is possible to choose or he or she it wants to receive the article or recieve a refund. At that moment Article 6.3 of these condictions becomes effective.

8.3 If the customer dissolves the agreement on the basis of Article 7.1, he or she must return the article immediately to Flame's Mystery, in a by Flame's Mystery indicated manner. The costs of returning are at the expense of the customer. The price of the article will be paid back within 10 working days on the account of the customer. Article 6.5 applies to this Article member.


9. GUARANTEES 9.1

On by Flame's Mystery the provided products exist 30 days guarantee.


10 COMPLAINTS

10.1 All complaints concerning the supply, quality, quality of the article(s) or every other complaint, will seriously be handled by Flame's Mystery.

10.2 The customer must make a complaint knowm to Flame's Mystery (data are indicated in Article 12 of these conditions).

10.3 Flame's Mystery will try to solve the complaint within 10 days. Flame's Mystery will in writing report to the customer about this (by means of letter or e-mail).


11. PRIVACY

11.1 Personal data which is registred at Flame's Mystery, will be exclusively used to be able to comply with the closed agreement. Just after in advance authorisation of the customer can Flame's Mystery use this obtained data to do personally specific offers to the customer.

11.2 Personal data which is processed, consists of all data which the customer himself fills in in the establishment form when he or she orders the article(s).

11.3 Flame's Mystery will not supply personal details of customers to third parties.

11.4 The customer can request an overview of his or her personal data at any time, by aiming a written (by means of letter or e-mail) request for that purpose to Flame's Mystery. Flame's Mystery will then, within 4 weeks after receiving the request, supplie an overview of the personal data present at Flame's Mystery. If the customer wishes that his or her personal data is updated, completed, removed or screened because these are actually incorrect, for above aim not complete or relevant, is or are processed in fight with a legal regulation, serves he or shethis (by means of letter or e-mail) to communicate in writing, where he or she indicates that the personal data is to be improved, completed, removed or screened. If the customer wishes that his or her personal data are to be improved and/or are completed, he or she indicates this in writing and supplies the improvements/supplements of those personal data. Flame's Mystery will in all cases perform these instructions immediately, unless the company not able at the time. In that case Flame's Mystery will remove the personal data.


12. Customer Service Of Flame's Mystery

All correspondence on the basis of these conditions must take place with:

13 APPROPRIATE RIGHT, CONCILIATION AND DISPUTES

13.1 On all agreements closed with Flame's Mystery applie Dutch laws.

13.2 If a dispute arises between the customer and Flame's Mystery as a result of an agreement closed between the customer and Flame's Mystery, the customer can request the consumer association to mediate unless the nature of this dispute does not justify such a conciliation.

13.3 If a dispute cannot be arranged on the basis of Article 12.2 or in an other manner of the law, the judge is in The Hague competent of this dispute, inspect unless the customer in writing communicates 4 weeks after the arise of the dispute (by means of letter or e-mail) to Flame's Mystery with his or her objection against this. In that case the rules of the statute book of civil Right progress apply.
